What is civil litigation?

Civil litigation is the legal process that decides money disputes between people. These disputes can happen when there are problems in communication and relationships or when someone is injured by another person. The main remedy in civil litigation is money damages. Money in a civil litigation case tries to make the plaintiff “whole” again or compensate them enough to where they are in their rightful position legally. This is different from criminal law cases where people fight against government agencies like the police and prosecutors and where people can go to jail. If you have been harmed by someone else and it has cost you money, then you might have a case in civil law that can result in money damages. There are many disputes that can be solved by civil litigation. Some of the most common types of claims fall under civil litigation. At Zeineh Law, we offer legal representation for personal injury, business disputes, and sexual assault litigation.

WHAT IS PERSONAL INJURY LITIGATION?

Personal injury litigation deals with the claims made when people are injured due to the negligence, recklessness, or intentional acts of another. In Michigan, injury victims can seek compensation for both physical and emotional injuries.

  • Auto and Truck Accidents: Auto and truck accidents are some of the most common types of accidents and can be the most serious. The industrial sector is a big part of Michigan, which results in many heavy trucks on the road transporting goods. Michigan is a no-fault state; this means that your insurance company is supposed to pay regardless of who causes the accident. A car accident claim in Michigan starts with your insurance company.
  • Burn Injuries: Burn injuries can occur from many types of accidents or malfunctioning equipment. A majority of burn injuries occur within a victim’s home. Burn injuries can lead to permanent physical injury and disfigurement along with long-term emotional damage. The medical expenses that result from burn injuries can be significant.
  • Toxic Mold Exposure Injuries: Mold can result in red and itchy eyes, wheezing and difficulty breathing from minor exposures. Mold exposure that is considered toxic can result in several long-term mental health effects. These effects include anxiety, depression, insomnia, confusion, and potentially a loss of memory.

  • What types of damages are available in personal injury cases?

There are two main categories of damages: economic and non-economic damages. Economic damages are the financial costs that have resulted from an incident. Common economic damages include things like medical bills and lost wages. Non-economic damages are the other personal costs that have resulted from an incident and are not easily calculable. Common non-economic damages include things like pain and suffering and mental anguish. When filing a claim, it is important to understand the true value of your case. To best understand what potential compensation you are eligible for, make sure to have your case evaluated by an experienced personal injury attorney.

  • What is business dispute litigation?

Businesses find themselves in litigation when there are disagreements or breakdowns in the communication between themselves and other parties. Communication and trust between parties are essential to conducting business. Once trust and/or communication have broken down between business associates, then business disputes and potential litigation often follow. Business litigation involves cases such as:

    • Contract disputes
    • Uniform Commercial Code (UCC) disputes
    • Business transaction disputes
    • Insurance litigation
    • Breach of fiduciary duty
    • Trade secrets disputes
    • Business torts such as fraud
    • Real estate disputes

These are not all of the types of cases that businesses can face.

  • What types of damages are available in business litigation cases?

When a person or business is alleged to have been involved in committing wrongful business practices, that person or business can be held liable for various money damages including:

    • Compensatory damages
    • Restitution damages
    • Compensatory damages
    • Liquidated damages

Business litigation plaintiffs can even recover punitive damages if the court finds that the defendant’s conduct was deliberate and intended to cause the plaintiff harm. Punitive damages, although uncommon, offer the biggest sums for recovery since they are damages that are not meant to pay for any costs an injured party incurred, but are meant to punish the bad actor for their conduct in a case.

  • What is sexual assault litigation?

In allegations of sexual assault, there is the potential of both criminal charges and a civil lawsuit. The standards of proof are much lower in sexual assault civil litigation when compared to a criminal charge. This lower burden of proof makes it extremely important to have experienced counsel, regardless if you are the plaintiff filing the lawsuit or the defendant defending against the lawsuit. At Zeineh Law, we are experienced in both plaintiff’s work and defense, and will use this experience for your benefit. Criminal charges are not required to bring a civil lawsuit, but convictions are very helpful when making a civil claim. There is a ten-year statute of limitations to bring a sexual assault claim from the date of the alleged incident.
